TERMS AND CONDITIONS - BULGARIA

Making a reservation and renting an apartment/s or rooms requires the approval of the regulations below.

I. TERMS USED IN THE AGREEMENT
SUMMERAPARTMENTS.EU SYSTEM– The system consists of the following Internet domain: www.summerapartments.eu.
ORDER– an electronic document is the only possible form of making a reservation of the service in aparteo.com system.
RESERVATION- An order of service (e.g. accommodation for the night) accepted and confirmed by the Operator. Reservation of the night’s accommodation is made by electronic reservation system available on the website: www.aparteo.com or by reaching the Operator at the call centre.
CLIENT- a natural or legal person, who has a legal capacity (according to the Polish Civil Code) and who uses the services of the Millennium Travel international Co Ltd, is held responsible for any payments.
OPERATOR- Millennium Travel International Co LTD, 171 Ballards Lane, Finchley, Londyn N3 1LP, UK
VOUCHER- a document that confirms concluding the agreement between the Client and www.aparteo.com service. It is necessary to present the document at the hotel/complex reception, in which the booking has been made by the Client.
EXTRA BED - a payable airbed or a folding bed provided by the Operator on the Client's request during the reservation process.

II. SUBJECT OF AGREEMENT
1. Defining the conditions on the basis of which the Operator provides the reservations of night’s accommodation in the Apartments or rooms and reservations of some other tourist services for and on the Client’s behalf, are the subject of the agreement.

III. SERVICE RESERVATION
1. Reservation of the night’s accommodation or some other tourist services is accomplished by filling in a Form in the system summerapartments.eu and sending the Order.
2. The Client is obliged to fill in the Order correctly. The Operator is not responsible for any consequences resulting from an Order filled incorrectly by the Client.
3. The Client is obliged to make sure that the Voucher confirming the service ordered was successfully delivered by an e-mail in 48 hours from the date of the reservation payment entering the Operator’s bank account. If the Client has not received the Voucher, he should inform the Operator immediately in order to receive a copy of the document.
4. The Operator does not guarantee a successful delivering of the Voucher if the Client’s e-mail box does not work properly. After the second unsuccessful attempt to send the Voucher, the document will be sent, in consultation with the Client, by the registered deliver letter or courier at Client’s expense.

IV. PRICES INCLUDED IN THE SYSTEM
1. Prices included in www.summerapartments.eu system are always announced for renting a whole Apartment or room for a night. Prices include all taxes and fees.
2. The Operator of the system informs and the Client accepts the fact that the prices included in the system can be changed without giving reasons. Yet, the Operator declares that the price presented to the Client in the document confirming the Agreement (Voucher) is the price, which Client is going to pay for the service. The Operator does not charge the Client for any additional fees for making a reservation.

V. RESERVATION
1. To make a reservation the Client is obliged to send a relevant form (taken from the system website: www.summerapartments.eu) to the Operator.
2. Within 24 hours on workdays or 48 hours on public holiday the Operator is obliged to confirm by an e-mail the availability of the Apartment in a given period of time chosen by the Client. If the places are not available, the Client will be informed via e-mail.(a workday means every day except for Saturdays, Sundays and public holidays in Poland).
3. If the reservation is possible, the Client receives an e-mail requesting for the acceptance of the Conditions of reservation and making an Initial Payment which constitutes 30% of the total sum of renting an Apartment.
3a. After receiving an Initial Payment from the Client, the Operator issues the THE CONFIRMATION OF RESERVATION (Voucher) for the Client. The Client is obliged to present the Voucher at the hotel, as the document allows him to use the services booked.
4. The Client pays the remaining amount of money (70%) in EUR when he checks-in at the hotel.
4a. The Client is also obliged to pay the Guarantee Deposit (150 EUR) together with the remaining amount of money upon the moment of check-in.
5. On the day of checking-out, an Employee of the Operator accounts for a Guarantee Deposit with the Client.

VI. CHANGE OR ANNULMENT
1. The Initial Payment is a non-returnable Operator’s Remuneration.
a) The Operator does not charge the Client for cancelling the booking unless it is later than 31 days prior to the date of planned arrival. The Operator does not receive any additional fees from the Client (apart from an Initial Payment).
b) The Client is obliged to pay 100% of the price, if he cancels the reservation without prior annulment or does not use the service ordered on time (no-show). The Initial Payment is included in the final account for the reservation as a prepayment.

VII. LIABILITY OF OPERATOR
1. The Operator obliges himself to make sure that the information presented in the system is true to life. The relevance of the information presented depends on a number of people cooperating with the Operator (e.g. business partners, apartment owners etc), on whom the Operator has no direct influence.
2. If it is not possible to accomplish the booking, the Operator will e-mail the Client and offer another service similar in standard, price and at the point of time ordered by the Client. The Client can resign from the alternative offer. In such a case the Operator returns all the Client’s costs within 5 workdays on the bank account indicated by the Client. The day of charging Operator’s bank account is considered the payment day.
3. If at the time of arrival to the Apartment, in the presence of the Operator’s employee, the Client claims that the Apartment is untidy or there are no clean towels or sheets, the Operator is obliged to provide the required service and to pay 25 EUR by way of compensation within 24 hours.
4. Returning the payment to the Client as a one-off compensation resulting from the Operator’s inability to provide the service ordered, exhausts the Client’s claim to the service.

VIII. LIMITATIONS OF OPERATOR'S LIABILITY
1. The Operator is not the owner of any Apartments presented at www.summerapartments.eu system, which means that:
a. The Operator is not responsible for any damage caused by the staff of the complex, in which the booked Apartment or room is located.
b. The Operator is not responsible for the incompatibility of the information provided by the apartment’s owner at www.summerapartments.eu service and the real shape of the apartment.
c. The Operator is not responsible for any inconveniencies or troubles occurring during the stay in the apartment or any other room/ building booked, which are caused by e.g. maintenance or repair of heating installation, temporary exclusion from recreational facilities (e.g. conservation of swimming pools), lack of water, energy, faulty air conditioners etc.
d. All of the claims should be submitted to the owner of the apartment or room.
2. Should an event of Force Majeure happen, independent of any of the sides, e.g. explosions, floods, fires, strikes, outbreak or danger of outbreak of war, martial law, sabotage, diseases or in the other extraordinary situations, the Operator is not held responsible for not providing the service ordered by the Client. The payment made by the Client can only be used by him to book another service at some other point of time.

IX. COMPLAINTS
1. Any complaints concerning the stay in the Apartment or hotel room should be submitted to the Operator’s Employee during the stay and sent to the Operator within 14 days after the check-out.
2. Not complaining to the Operator’s employee during the stay at the Apartment/ room deprives the Client of any complaint rights.
3. The Operator is obliged to investigate any submitted complaint within 21 workdays from the date of receiving it.

X. CLIENTS` DATA
1. By placing an order and making a reservation by the Operator’s agency, the Client gives his consent to his personal details being stored at the database of Millennium Travel International Co LTD. The data will be used only to make reservations, to facilitate making reservations in the future, and for commercial purposes in accordance with the existing laws.

XI. ACCEPTANCE OF RESERVATION CONDITIONS
1. The Client, who has placed an order in the Operator’s system, and accepted the reservation conditions in the Order, declares that he knows “Reservation Conditions” and is fully aware of their consequences.

XII. CONCLUDING ARRANGEMENTS
1. The Reservation Conditions were created according to and in accordance with the English law. Any subjects of litigations related to the importance, interpretation and execution of this Agreement, for which an amicable settlement of the dispute would not be possible, are adjudicated by the Court proper the Operator’s registered office.

2. The Operator of the system informs and the Client accepts the fact that the prices included in the system can be changed without giving reasons. Yet, the Operator declares that the price presented to the Client in the document confirming the Agreement (Voucher) is the price, which Client is going to pay for the service. The Operator does not charge the Client for any additional fees for making a reservation.

V. RESERVATION
1. To make a reservation the Client is obliged to send a relevant form (taken from the system website: www.summerapartments.eu) to the Operator.

3. If the reservation is possible, the Client receives an e-mail requesting for the acceptance of the Conditions of reservation and making an Initial Payment which constitutes 20% of the total sum of renting an Apartment.
3a. After receiving an Initial Payment from the Client, the Operator issues the THE CONFIRMATION OF RESERVATION (Voucher) for the Client. The Client is obliged to present the Voucher at the hotel, as the document allows him to use the services booked.
4. The Client pays the remaining amount of money (80%) in EUR when he checks-in at the hotel.

VI. CHANGE OR ANNULMENT
1. The Initial Payment is a non-returnable Operator’s Remuneration.
a) The Operator does not charge the Client for cancelling the booking unless it is later than 14 days prior to the date of planned arrival by phone and confirmed by e-mail. The Operator does not receive any additional fees from the Client (apart from an Initial Payment).
b) The Client is obliged to pay the amount for 3 nights, if the reservation is cancelled less than 14 days prior to the date of planned arrival.
c) The Client is obliged to pay 100% of the price, if he cancels the reservation without prior annulment or does not use the service ordered on time (no-show). The Initial Payment is included in the final account for the reservation as a prepayment..

VII. LIABILITY OF OPERATOR
1. The Operator obliges himself to make sure that the information presented in the system is true to life. 4. The Operator is obliged to investigate any submitted complaint within 21 workdays from the date of receiving it..

X. CLIENTS` DATA
